Important Notice - No Medical Advice

Prescript.ng is a facilitator. We do not provide medical diagnosis, and we are not a pharmacy. We connect users to licensed pharmaceutical providers.

The Service does not constitute medical advice, diagnosis, or treatment. Always seek the advice of Your physician or other qualified health provider with any questions You may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something You have read or accessed through the Service.

Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of these Terms of Service:

  • Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
  • Country refers to: Nigeria
  • Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to GigiPod Online Services LTD LLC, the developers and providers of the Prescript mobile application (iOS and Android) and related services, in partnership with Haipa Technologies Solutions Ltd (https://www.haipatech.com).
  • Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
  • Pharmacy Partner means a licensed pharmaceutical provider registered on our platform to fulfill prescription orders.
  • Service refers to the Prescript mobile application and Website.
  • Terms of Service (also referred as "Terms") mean these Terms of Service that form the entire agreement between You and the Company regarding the use of the Service.
  • Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.
  • Website refers to Prescript, accessible from https://prescript.ng
  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Nature of Our Service

Prescript.ng operates as a technology platform that facilitates connections between patients/users and licensed pharmacies. Our role is strictly limited to:

  • Providing a platform for You to upload prescription images
  • Connecting You with licensed Pharmacy Partners who can fulfill Your prescriptions
  • Facilitating communication between You and Your chosen pharmacy
  • Processing payments on behalf of Pharmacy Partners
  • Coordinating delivery logistics where applicable

We are not:

  • A pharmacy or pharmaceutical retailer
  • A healthcare provider or medical practitioner
  • A source of medical advice, diagnosis, or treatment recommendations
  • Responsible for the clinical decisions made by Pharmacy Partners

Acknowledgment

These are the Terms of Service governing the use of this Service and the agreement that operates between You and the Company. These Terms of Service set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms of Service. These Terms of Service apply to all visitors, users and others who access or use the Service.

By accessing or using the Service You agree to be bound by these Terms of Service. If You disagree with any part of these Terms of Service then You may not access the Service.

User Responsibilities

By using our Service, You agree to:

  • Only upload valid prescriptions issued by licensed medical practitioners
  • Provide accurate personal and contact information
  • Not use the Service for any unlawful purpose or to obtain controlled substances illegally
  • Verify the medications received match Your prescription before use
  • Report any discrepancies or concerns to both the Pharmacy Partner and Us immediately
  • Not share Your account credentials with others

Pharmacy Partners

All Pharmacy Partners on our platform are required to be licensed by the Pharmacists Council of Nigeria (PCN) and comply with all applicable pharmaceutical regulations. However, We do not guarantee the availability, pricing, or quality of medications from any Pharmacy Partner. The contractual relationship for the supply of medications is directly between You and the Pharmacy Partner You select.

Payments

Payments for medications and services are processed through our third-party payment partners, Flutterwave and Monnify. By making a payment through the Service, You agree to the terms and conditions of these payment processors. All prices displayed are in Nigerian Naira (NGN) unless otherwise stated.

Account Deletion

In accordance with App Store guidelines, You may request permanent deletion of Your account and prescription history at any time. To do so, please visit our Account Deletion page. Deletion requests are processed within 30 days.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms of Service.

Upon termination, Your right to use the Service will cease immediately.

Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding:

  • The accuracy or completeness of information provided by Pharmacy Partners
  • The availability of specific medications
  • The suitability of any medication for Your specific condition
  • Uninterrupted or error-free operation of the Service

Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of these Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 100 USD if You haven't purchased anything through the Service.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of these Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Medical Disclaimer: We are not liable for any adverse health outcomes resulting from medications obtained through Pharmacy Partners on our platform. All medical decisions and pharmaceutical dispensing are the responsibility of the licensed Pharmacy Partner and the prescribing healthcare provider.

Indemnification

You agree to indemnify and hold harmless the Company, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from Your use of the Service, Your violation of these Terms, or Your violation of any rights of another party.

Governing Law

The laws of the Federal Republic of Nigeria, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

Dispute Resolution

Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through the courts of competent jurisdiction in Nigeria.

Changes to These Terms of Service

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
